PRIVACY NOTICE

TISCO NETWORKS LLC (“TISCO,” “we,” “us,” or “our”), with its address at 11500 Pellicano Dr Ste B9, El Paso, TX 79936, United States, explains in this Privacy Notice how it processes personal information of client representatives, contacts, and authorized users in connection with technical support, monitoring, and information technology management services through Atera.

This Notice concerns the service described above and applicable U.S. federal and state privacy and data security requirements, including the Texas Business & Commerce Code, Chapter 521, and the Texas Data Privacy and Security Act, Chapter 541, to the extent applicable. The rights described below depend on the law governing the processing and TISCO’s role.

  1. PERSONAL DATA PROCESSED

Depending on the support requested and the contracted service, TISCO may process:

  • Identification and contact information: Name, company, job title, email address, telephone number, and requester or authorized user details.
  • Account and authorization information: User, client, or site identifiers; roles and permissions; and evidence authorizing support or access.
  • Technical service information: Device names and identifiers, IP addresses, operating systems, serial or asset numbers, configurations, connectivity status, inventory, alerts, events, and diagnostic logs.
  • Tickets and communications: Requests or incidents, submitted files or screenshots, dates, service times, activities performed, assigned technician, resolution, closure, and related communications.
  • Remote support and security information: Session dates and duration, devices serviced, authorizations, technical actions, and access or activity logs available in the tools used.

Information is obtained from requesters, authorized client contacts, and the devices and tools used to provide the service. Do not include unnecessary sensitive information or permanent passwords in tickets or attachments. Temporary credentials needed for authorized support must be shared through the secure channel established for that activity.

  1. NECESSARY PURPOSES

Personal information is processed to:

  • Identify requesters, verify their relationship with the client, and manage accounts and authorizations.
  • Receive, classify, assign, diagnose, address, escalate, document, close, and, when necessary, reopen support tickets.
  • Monitor devices, respond to alerts, and perform remote support, changes, updates, automations, or maintenance within the contracted service and client authorization.
  • Communicate progress, request information, document approvals, measure service times, and maintain support records.
  • Prevent, detect, investigate, and address security incidents, unauthorized access, misuse, and technical failures.
  • Meet legal and contractual obligations, support relevant audits, and protect legal rights, using only information necessary for those purposes.

TISCO does not use service information for unrelated marketing or commercial profiling. If information essential to the requested service is unavailable, TISCO may be unable to complete that service, without limiting rights protected by law.

  1. TISCO AS DATA CONTROLLER AND DATA PROCESSOR

TISCO acts as a controller or business, as applicable, when it determines the purposes of processing contact, account, authorization, or service administration information. When it accesses or processes information in client devices, systems, applications, tickets, or attachments solely under the client’s instructions, TISCO acts as a processor or service provider.

The client remains responsible for its own privacy notices, permissions, and other legal obligations regarding that processing. Each party retains its applicable duties. This Notice does not replace the client’s privacy notice or authorize processing beyond the client’s instructions.

  1. USE OF ATERA, DATA PROCESSORS, AND DATA TRANSFERS

TISCO uses Atera to provide the service. Relevant contact, account, technical, ticket, and remote support information may be disclosed to Atera and providers of hosting, communications, storage, security, or technical support as necessary for service delivery, subject to applicable confidentiality, security, and data processing terms.

Atera’s processing on a client’s behalf is addressed in its Data Processing Addendum, under which it acts as a processor or subprocessor according to the relationship. Its Privacy Policy describes its own processing activities. These documents do not replace TISCO’s obligations.

Support is operated from Chihuahua, Mexico. Information may be accessed from Mexico and processed in countries where Atera and its authorized providers operate, in accordance with applicable data processing terms and law.

Information may also be disclosed to the client’s authorized contacts as needed for the service or to competent authorities as required by law. Where consent is legally required for a disclosure, it will be obtained beforehand.

  1. SECURITY MEASURES AND DATA RETENTION

TISCO maintains administrative, technical, and physical safeguards proportionate to the risks, including access controls, confidentiality, provider management, activity logging, and incident handling.

Contact, account, and authorization records are retained while needed to manage the service relationship and related obligations. Tickets and communications are retained to deliver and document support, resolve issues, and meet legal or contractual requirements. Technical, monitoring, and remote support records are retained according to diagnostic, security, and contractual needs.

Information is deleted or deidentified when no longer needed, subject to applicable retention requirements and client instructions. Copies in Atera backups may remain until the applicable backup retention period expires, subject to its Data Processing Addendum.

When a security incident requires notification, TISCO will notify the relevant client, affected individuals, or authorities as required by applicable law and contractual obligations.

  1. PRIVACY RIGHTS, WITHDRAWAL OF CONSENT, AND LIMITATION OF USE OR DISCLOSURE

Depending on applicable law, individuals may request access, correction, deletion, or a portable copy of their personal information; withdraw consent where processing relies on it; and exercise applicable rights to limit or opt out of specified uses or disclosures. These rights are subject to legal exceptions and TISCO’s role in the processing.

Submit privacy requests to contact@tisconetworks.com or by mail to TISCO NETWORKS LLC, 11500 Pellicano Dr Ste B9, El Paso, TX 79936, United States. Include your name, contact details, the relevant client or service, and a description of the information and right involved. For corrections, identify the information to be corrected.

TISCO may request information necessary to verify identity or an authorized representative’s authority where permitted by law. Do not send passwords or unnecessary identity documents. Requests do not require a new account and are handled without charge unless a legal exception permits a fee.

TISCO will respond within the period required by applicable law and explain any permitted extension or denial. If an appeal right applies, reply to the decision or email the contact above with the subject “Privacy Appeal.” TISCO will provide its decision within the legal period and, where required, instructions for contacting the relevant state authority. TISCO will not unlawfully discriminate against anyone for exercising privacy rights.

Requests about information processed solely for a client should be directed to that client. TISCO will assist in routing the request and support the client as required by law and the service agreement.

  1. CHANGES TO THIS PRIVACY NOTICE

Updates will be published on the webpage where this Notice appears, with a revised last updated date. Where applicable law requires additional notice or consent for a material change or new purpose, TISCO will provide that notice or obtain that consent before the change takes effect.
